Dangerous Substances (Flammable Liquids and Fuels) Licensing

Licensing of Flammable Liquids and Fuels is under the provisions of the Dangerous Substance Act 1972 (No. 10of 1972) and Regulations 2019

Kerosene (Category 2) and Diesel (Category 3 Flammable Liquid) were declared a Dangerous Substance under the Dangerous Substance Act 1972 (Part IV Declaration) Order 2020 and as such a licence is required when stored as set out in the Regulations.

There are two sets of Regulations as follows:-

Regulation S.I. No. 630 of 2019

These Regulations may be cited as the Dangerous Substances (Flammable Liquids and Fuels Retail Stores) Regulations, 2019.

These Regulations repeal and replace the Dangerous Substances (Retail and Private Petroleum Stores) Regulations, 1979 (No. 311 of 1979).

These Regulations came into operation on 1 April 2020.

Private Stores are now Regulated under the Distribution and Commercial Supply Regulations (S.I. 631 of 2019)

Regulation S.I No. 631 of 2019

These Regulations may be cited as the Dangerous Substances (Flammable Liquids and Fuels Distribution and Commercial Supply Stores) Regulations, 2019.

These Regulations repeal and replace the Dangerous Substances (Petroleum Bulk Stores) Regulations, 1979 (No. 313 of 1979).

These Regulations came into operation on 1 April 2020.

Licence Obligations

For Retail and Kerbside Stores

All retail and kerbside stores which store flammable liquids and fuels for the purpose of sale or supply to the public must have a licence to operate, granted by the appropriate licensing authority.

For Distribution and Commercial Supply Stores

Bar exemptions as outlined in Dangerous Substances (Flammable Liquids and Fuels Distribution and Commercial Supply Stores) Regulations, 2019, and summarised below, distribution and commercial supply stores which hold flammable liquids and fuels for supply or sale to commercial enterprises, for supply to the licensee’s own vehicle, or for use in any engine under the licensee’s control must have a licence granted by the appropriate licensing authority.

The exemptions include:

  • Fuel stored for domestic heating
  • Fuel stored for private agricultural vehicles or premises,
  • Storage for manufacturing
  • Refineries, and oil jetties (which are addressed under separate Dangerous Substances Regulations)
  • Storage of category 1 flammable liquids (e.g. petrol) < 2,000 Litres
  • Storage of category 2 and 3 flammable liquids (e.g. diesel) < 5,000 Litres

Application Forms

Application Forms are used for:-

·         A First Licence, or

·         An Amended Licence, or

·         A Renewal of a Licence, or

·         A Transfer of a Licence

Please note it is the responsibility of the licensee or owner or operator of a store, to ensure that the person engaged to carry out a risk assessment meets the criteria of a competent person as defined in Regulation 2.

Licence Fees

Local Authorities charge a fee for licences under the Dangerous Substances Act. The Fees charged are included in the application form

Please note that the current licensing fees as set out in S.I. 301 of 1979 are under review, and are likely to change in the future.
