Extension of Duration of Planning Permission
Under Section 42 of the Planning and Development Act 2000 (as amended), in certain circumstances, it may be possible to extend the appropriate period of a grant of permission. An application for such an extension must be made under this section of the Act.
Please be aware that applications for the Extension of Duration of Planning Permissions (under section 42 of the Planning and Development Act 2000) are subject to new provisions in the Planning and Development (Amendment) Act 2021 (effective 09 September 2021).
The guidelines for applying for an extension of duration of permission are:
- A statutory fee of €62 is payable (Standard fee for all applications).
- Applications should be made, not earlier than the last year of the life of the permission (but before it expires).
- You may only apply if works have commenced or are substantially complete.
- Applicants should note that the planning authority will make a decision as expeditiously as possible and will give notice of its decision within 8 weeks. However, should further information or clarification of further information be first required, it is most important that your response must be received within 4 weeks of such requirement. The planning authority shall not extend the application if this requirement is not adhered.
